Terms and Conditions

1. scope of application, contractual partner

The following General Terms and Conditions (GTC) apply to all offers of inge Manufaktur GmbH, Wächterhofstr. 50, 85635 Höhenkirchen Siegertsbrunn, in the online store available at store.die-inge.de. The contractual relationship between you and us is governed exclusively by these GTC. Any other terms and conditions of the customer are expressly rejected. If you are an entrepreneur within the meaning of § 14 BGB (German Civil Code), the inclusion of your conflicting GTC requires our written consent.

 

2. Order process and conclusion of contract

The presentations in the online store do not constitute a binding offer from us, but a non-binding invitation to you to submit an offer.

By clicking on the button “order with obligation to pay” you submit a binding offer. Before completing the order process, you will be shown a confirmation window with the details of your order. Here you can check your entries again and correct them if necessary. After submitting the offer, you will receive an automated confirmation e-mail with the details of the order (order confirmation). The order confirmation does not yet constitute a contract. The contract is only concluded when we accept your offer. Acceptance takes place by means of a separate e-mail (order confirmation). We have the option of accepting or rejecting your offer within two working days.

Notwithstanding the above provision, the contract shall be concluded beforehand in the following cases:

  • In the case of payment by credit card, the contract is concluded at the time the credit card is charged.
  • In the case of payment by PayPal or Sofortüberweisung, the contract is concluded at the time of confirmation of the payment instruction to PayPal or Sofortüberweisung.
  • In the case of payment in advance, the contract is concluded at the time when we ask you to make the payment with reference to our bank details.

3. Right of withdrawal
If you are a consumer within the meaning of § 13 BGB (any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed), you have a statutory right of withdrawal.

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

To exercise the right to cancel, you must inform us (inge Manufaktur GmbH, Wächterhofstr. 50, 85635 Höhenkirchen Siegertsbrunn, Phone: +49 8102 - 9956510, Email: kontakt@die-inge.de) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, e-mail). You can use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

You can use the sample withdrawal form below to exercise your right of withdrawal.

Consequences of revocation

If you withdraw from the contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or you have provided proof that you have sent the goods back to us, whichever is the earliest. You must return or hand over the goods to us immediately and in any case no later than 14 days from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the 14-day period has expired. You shall bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

Exclusion of the right of withdrawal:
Pursuant to Section 312g (2) No. 1 BGB, the right of withdrawal does not apply to distance contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the needs of the consumer.

There is also no right of withdrawal in accordance with Section 312g (2) No. 2 BGB for distance contracts for the delivery of goods that can spoil quickly or whose expiration date is quickly exceeded.

Furthermore, the right of withdrawal according to § 312g para. 2 no. 3 BGB does not apply to distance contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

4. storage of the contract text
The text of the contract is stored by us and can be requested at any time. In addition, the order data and the GTC will be sent to the e-mail address you have provided as part of the order confirmation. If you have created a customer account, you can view the details of your order there again at any time.

5. Delivery (transfer of risk, if applicable)
Delivery or shipment is made exclusively to Germany.

Delivery will be made to the delivery address you specify.

6. Protection of minors
In accordance with the German Youth Protection Act (JuSchG), we only deliver to persons over the age of 18. The buyer confirms with the order with the agreement to our terms and conditions that he has the required age according to the Youth Protection Act.

7. Prices and shipping costs
The prices stated in the online store are gross prices including statutory VAT. The amount of the shipping costs depends on the shipping method you choose. The respective shipping costs can be viewed here: Shipping methods/delivery times

8. payment
The means of payment specified in the online store are available for payment.

9. VOUCHERS

9.1 inge Manufaktur GmbH offers various types of vouchers: Gift Vouchers, Promotional Vouchers and Compensation Vouchers:

9.1.1 Gift vouchers

9.1.1.1 Gift vouchers are vouchers that can be purchased in our online store and can only be redeemed at www.die-inge.de, unless otherwise stated on the voucher. The gift voucher will be sent to you by email after your order.

9.1.1.2 Gift vouchers can only be used to purchase products in the inge online store and cannot be used to purchase other gift vouchers.

9.1.1.3 For technical reasons, inge Manufaktur can only accept one gift voucher per order.

9.1.1.4 Gift vouchers and remaining credit on gift vouchers can be redeemed until the end of the third year after the year in which the voucher was purchased.

9.1.1.5 If the price of your order exceeds the balance of a gift voucher, you can make up the difference using the payment methods offered. If the price of your order is less than the balance of a gift voucher, you can redeem the remaining balance on your next order.

9.1.1.6 In the event of a contract being rescinded - for whatever reason - the purchase price will be refunded by means of a chargeback to the gift voucher account and any additional means of payment used.

 

 

9.1.1.7 The gift voucher is transferable.

9.1.1.8 Lost, in particular stolen, voucher codes will not be refunded. inge Manufaktur GmbH accepts no liability for lost voucher codes.

9.1.2 Promotional vouchers

9.1.2.1 Promotional vouchers are vouchers that are issued free of charge as part of advertising campaigns with a specific period of validity and cannot be purchased by you. Promotional vouchers can only be redeemed at www.die-inge.de during the specified period, but not for shipping costs. Promotional vouchers may be subject to further, individual conditions. These will be communicated to you in direct connection with the voucher.

9.1.2.3 First registration or new customer vouchers, which you receive once for registering on the www.die-inge.de website for registration in the store, may only be redeemed once per customer account.

9.1.2.4 Only one promotional voucher can be redeemed per order. It is not possible to refund or credit the remaining balance of a promotional voucher if the value of the purchase is less than the value of the voucher.

9.1.2.5 The promotional voucher is non-transferable, non-refundable and cannot be redeemed again if you return the goods or services paid for in full or in part with the voucher within the scope of the statutory right of withdrawal. If you return ordered goods in part, the value of the voucher will be distributed proportionally to the goods ordered, i.e. if individual items are returned, the voucher will be credited proportionally to the price of the returned goods and will expire in proportion to the value of the goods. If a voucher is linked to a minimum order value, this must also be reached if goods are partially returned, otherwise the voucher value will not be credited.

9.1.4 Compensation vouchers

9.1.4.1 Compensation vouchers are vouchers that cannot be purchased, but are issued by inge Manufaktur at its own discretion as compensation without recognition of a legal obligation.

9.1.4.2 The regulations on promotional vouchers shall apply accordingly.

9.2 inge Manufaktur GmbH may block the corresponding voucher code (also temporarily) or refuse redemption (also temporarily) in the event of justified suspicion of fraud or other activities contrary to the law or conditions in connection with the purchase or redemption of a voucher. In the latter case, you have the right to cancel the order.

9.3 Payment of the voucher amount is not possible, nor is a transfer for value or subsequent offsetting for purchases already made, i.e. before completion of the order process.

9.4 The aforementioned vouchers can only be redeemed by consumers.

10. Retention of title
The goods remain our property until full payment has been made.

 

11. Limitation or exclusion of liability
We are liable for intent and gross negligence. Furthermore, we are liable for the negligent breach of obligations, the fulfillment of which is essential for the proper execution of the contract, the breach of which jeopardizes the achievement of the purpose of the contract and on the observance of which the customer regularly relies. In the latter case, however, we shall only be liable for the foreseeable damage typical of the contract. We shall not be liable for the slightly negligent breach of obligations other than those mentioned in the above sentences.
The above exclusions of liability shall not apply in the event of injury to life, limb or health. Liability under the Product Liability Act remains unaffected.
The above exclusions of liability also apply in favor of the legal representatives and vicarious agents of the provider, if you assert claims against them.

12. Alternative dispute resolution pursuant to Art. 14 para. 1 ODR Regulation and § 36 VSBG
The European Commission provides a platform for online dispute resolution (OS), which the customer can reach at http://ec.europa.eu/consumers/odr. We are not obliged to participate in a dispute resolution procedure before a consumer arbitration board. We do not participate in dispute resolution proceedings.

13. Contract language
The contract language is German.

14. Applicable law and place of jurisdiction
The law of the Federal Republic of Germany shall apply to orders placed by entrepreneurs within the meaning of § 14 BGB, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, a legal entity under public law or a special fund under public law, Munich shall be the place of jurisdiction.

15. Final provisions
Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. Furthermore, the parties undertake - provided that you are an entrepreneur within the meaning of § 14 BGB - in the event that a provision is invalid, to replace it with a new provision that comes as close as possible to the legal and economic meaning and purpose of the invalid provision.
